1. GENERAL ENTRY

Information on how to enter and prizes form part of these Conditions of Entry. By entering and/or participating in the $50 BIG6 free bet Promotion ("Promotion"), each participant fully and unconditionally agrees and acknowledges that these Conditions of Entry and the decision of the Promoter on all matters relating to this Promotion is final and binding.

Entry is open to all account holders, aged 18 years of age and over, that open an account except those that reside in Victoria and South Australia.

Directors, officers and employees of (and contractors to) the Promoter and its related companies and their immediate family are not eligible to participate in the competition. "immediate families" means a spouse (including de facto), parent, sibling, child, grandparent, grandchild, or parent in law and includes stepparents and stepchildren and half siblings.

All Participants consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable promotional activities as requested by the Promoter.

Any entry that fails to provide all required information may be disqualified. The Promoter assumes no responsibility for incomplete, late or misdirected entries, or entries received through impermissible or illegitimate channels or for failed, partial or garbled computer transmissions, or for technical failures of any kind. The Promoter reserves the right to disqualify any entrant submitting an entry which is not made in accordance with the terms of these Conditions of Entry or who does not abide by the website Conditions of Entry.

2. TERM OF PROMOTION

The Promotion commences on Friday 30 October 2009 at 06:00 (AEST) and will run until the earlier of sixty (60) Eligible Participants opening a new TAB account or on Tuesday 3 November 2009 at 15:00 (AEST) ("the Promotional Period").

3. HOW TO ENTER

To take part in the Promotion, Eligible Participants must create a valid TAB betting account via mycupsweep.com.au for the first time during the Promotional Period.

Each Eligible Participant is entitled to open one account only. Each Eligible Participant is entitled to one $50 BIG6 free bet on Emirates Stakes Day.

The Promoter reserves the right to disqualify any entry if that entry is not made in accordance with the terms of these Conditions of Entry.

4. PRIZE DRAW

Over the course of the Promotional Period, the first sixty (60) Eligible Participants that open a new TAB account via mycupsweep.com.au for the first time will each win a $50 BIG6 free bet. The winners will be notified by telephone by 6pm on Wednesday 4 November 2009. The name and suburb of the prize winners will be published on the www.tab.com.au website.

5. PRIZES

The Promotion is comprised of 60 individual BIG6 free bets, each valued at $50 each (the "Prizes").

The total prize pool is $3,000.

Each winner will be notified by telephone of their success on Wednesday 4 November 2009. Winners are only permitted to place one BIG6 bet. The bet can be a Multiple BIG6, however must be limited to the one transaction.

It is a requirement that each winner must select a thoroughbreds BIG6 that is conducted on Emirates Stakes Day, Saturday 7 November 2009 and can choose either the NSW TAB or Victorian TAB.

The Prize must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars.

Customers may retain all winnings generated from their free $50 BIG6 bet. There is no requirement to turn any winnings over.

6. TAX STATEMENT


Any taxes which may be payable as a consequence of the winner receiving the prize are the sole responsibility of the winner. TABCORP accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial and tax advice should be sought.

7. EXCLUSION OF LIABILITY

To the extent permitted by law, TABCORP is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by TABCORP or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Participant or a prize winner.

Nothing in these Conditions of Entry affect, nor is intended to affect, any rights that a Participant might have that are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of TABCORP or its servants or agents for breach of any such rights is limited to the supplying of the relevant goods or services again.

8. GENERAL CONDITIONS

8.1 TABCORP, its employees, officers, agents, and its parent companies and subsidiaries are not responsible for and shall not be liable for:

(i) any condition caused by events beyond the control of TABCORP that may cause the game to be disrupted or corrupted;
(ii) any injuries, losses (including, without limitation, loss of profits), or damages of any kind (even where resulting from negligence of TABCORP or any other person) caused by the prize or resulting from acceptance, possession, use, or misuse of the prize, or from participation in the game or downloading material from the website; or
(iii) any printing or typographical errors in any materials associated with the Promotion.

8.2 TABCORP reserves the right, in its sole discretion, to cancel or suspend the Promotion, should virus, bugs, unauthorized human intervention, or other causes beyond the control of TABCORP, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the game or to disqualify any participant who engages in offensive, illegal or objectionable conduct. TABCORP reserves the right in its sole discretion to disqualify any individual who tampers with the entry process including but not limited to, techniques designed to avoid payment of call costs, or who submits an entry that is not in accordance with these Conditions of Entry. The promoter also reserves the right to request winners to provide proof of age, identity or proof of residency at the nominated prize delivery address. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by any relevant government or regulatory authority, to cancel, terminate, modify or suspend he t promotion. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.

8.3 Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured. All entries become the property of TABCORP. The information participants provide will be used by TABCORP for the purpose of conducting this Promotion.

8.4 TABCORP may disclose participants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with participants.

8.5 By entering the Promotion, Participants consent to their personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this promotion, and business partners for any promotional activities, including the Participant's personal participation in reasonable promotional activities as requested by the Promoter, any marketing and publicity purposes without any further reference, payment or other compensation to the Participant. The Participant's consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this promotion and business partners to send the participant future electronic messages including but not limited to, SMS, MMS, and email regarding any promotional, marketing and publicity activities.

8.6 Participants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at its address set out below.

8.7 Decisions of the management of the Promoter are final. No correspondence will be entered into.

8.8 The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the Prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the Prize.

8.9 It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

8.10 To the extent that a situation or issue arises for which these Conditions of Entry make no provision or in relation to which the relevant Conditions of Entry are unclear, the Promoter also reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding.

8.11 In the event that the winner is identified as a self excluded patron or involuntarily excluded patron of the Promoter, the Promoter reserves the right to refuse to allow a winner to take part in, or receive any or all aspects of the Prize.

9.UNCLAIMED PRIZE DRAW

If prizes are not claimed within 3 months after the completion of the promotion, an unclaimed prize draw will be conducted at AEST 10:00am on Wednesday 3rd February 2010 at Tabcorp Holdings Ltd, 495 Harris St, Ultimo, NSW subject to any written directions.
